Who doesn’t remember the confusion between a man, Globo and a rather large Pix? Well, the case experienced new developments this Wednesday (November 5th). The man eventually repaid the R$318,000 to the broadcaster but is still embroiled in legal troubles.
According to reporters Gabriel Vaquer and Li Lacerda of Notícias da TV, the court denied the man’s motion to have the case dismissed and will proceed with the proceedings. The reason is the understanding that there was a misappropriation of value when buying an apartment.
The file, which will be judged in the 3rd Civil Court of the Court of Justice of Rio de Janeiro, indicates that the lawyer Marcos Antônio Rodrigues dos Santos, the target of the lawsuit, stated that the proceedings should end with the return of the “ pix of millions”.
He also claims, according to the report, that the case is not relevant to the public and asked that it be kept secret from the judiciary. Both requests were denied by Judge Luiz Felipe Negrão.
In the first case, the judge points out that the man only deposited the money to get back the apartment that he would have bought with the value of Pix, without acknowledging the debt he owes to the global broadcaster, indicating that he would have posted the bail in good faith. Regarding the request for secrecy, Negrão pointed out that the case did not fit into the situations provided for by the penal code.
“I reject the application for judicial secrecy because the matter dealt with in the present application does not fit into any of the proposed hypotheses,” said the magistrate.
Consider the case of Pix
Globo found itself in a very complicated and unusual situation due to an employee error. The broadcaster made a mistake in creating an image and transferred BRL 318,000 to a man’s account. Realizing the money was in his account, he ran to buy a house, causing uneasiness for the broadcaster, who had to go to court to try to recover the money.
The whole problem happened at the end of 2021, on December 27th. After the conclusion of an employment contract and after a court decision, the deposit was paid on the same day. However, the department responsible for the payment claimed that due to an error, an employee of the channel missed the data and sent the amount to Marcos Antônio Rodrigues dos Santos, who had nothing to do with the story.
When he saw the full amount in his account, he assumed he’d received a promotion, thought it was rightfully his, and kept the number. Shortly after the turn of the year Marcos demolished his own house.
A few days later, Globo contacted the man to request a refund. However, since he had already invested in his personal growth, he shared that this option was not possible. And then the station went to court to reverse the case.
