Olona, ​​​​who resigned from her seat last year to present herself as a Vox candidate for the Junta de Andalucía, has returned today to the Palace of Parliament to present a Popular Legislative Initiative (ILP) to protect minors from violence and false accusations in the family environment.

The former parliamentarian, who returned to the prosecutor’s office after splitting from her old party, took the opportunity to cap her speech in May 2020 when, from the lectern, she asserted that “violence has no gender”. He has insisted on dismissing the term gender-based violence because he says it “criminalizes 50% of the population for being male”, but he has pointed out that many of the men who abuse it do so because they believe , that this woman is her property, which constitutes an act of machismo. “I want to express myself with absolute clarity so that anyone who thinks my speech gave them wings would deny it [la violencia machista] stop using it,” he added.

The draft law presented by Olona aims to amend the Civil Code so that the parent (regardless of gender) who is finally sentenced to a prison term of more than two years has guardianship or custody of the minor during the sentence waived prison for violating the life, liberty, physical or moral integrity and sexual freedom of the couple or the children living with them; It is not enough, like now, that he is “in criminal proceedings”. The other novelty is that the removal of guardianship or custody of the children applies to those who accuse the other parent of one of these crimes “with knowledge of their untruth or reckless disregard of the truth”; that is, who makes false complaints.

Once the Popular Legislative Initiative has been submitted, the Board of Congress must approve it for processing. From that moment begins a period of nine months, which can be extended to 12, to collect half a million signatures, necessary to start the parliamentary process. Olona – who is not a member of the ILP Funding Committee – is confident she can collect the signatures without her term of office expiring. The Murcia assembly, at the suggestion of the Vox MPs who faced the party leadership, approved a similar proposal that has yet to be discussed in Congress.
